1. Agreement Formation

When you make a booking with Clear Vacation Trips ("Clear Vacation Trips", "we", "us", or "our"), you enter into a legally binding agreement. This contract is formed when we issue a written booking confirmation via email. By making a booking, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

Your booking is subject to acceptance by Clear Vacation Trips. We reserve the right to decline any booking at our discretion, with a full refund of any amounts paid.

2. Pricing & Payments

Pricing: All prices are quoted in Malaysian Ringgit (MYR) and include applicable taxes unless otherwise stated. Prices are subject to change without notice, but once your booking is confirmed, the price is guaranteed.

Deposit: To secure your booking, a non-refundable deposit of 30% of the total package price is required. For certain high-demand departures (peak season, limited-availability experiences), a deposit of up to 50% may be requested.

Final Payment: The balance is due 60 days prior to departure. If payment is not received by the due date, we reserve the right to cancel your booking and retain the deposit. For bookings made within 60 days of departure, full payment is required at the time of booking.

Payment Methods: We accept credit cards (Visa, Mastercard, American Express), PayPal, and bank transfers. All payments must be cleared before any travel documents are released.

3. Cancellations & Refunds

You may cancel your booking by notifying us in writing via email at [email protected]. The following cancellation charges apply, calculated from the date we receive your written notification:

• 90+ days before departure: Refund of total price minus the non-refundable deposit (30%).
• 60–89 days before departure: 50% refund of the total package price.
• 30–59 days before departure: 25% refund of the total package price.
• Less than 30 days before departure: No refund is available.

Important: For bookings involving flights, cruises, or event tickets, the supplier's cancellation policy may apply and could supersede our standard terms. We will inform you of any such conditions at the time of booking. We strongly recommend purchasing comprehensive travel insurance to protect against cancellation penalties.

4. Changes & Modifications

Changes initiated by you: We understand that plans can change. If you wish to amend your booking (e.g., date change, destination change, room upgrade), we will make every effort to accommodate your request. An administrative fee of RM 200 per booking applies, in addition to any supplier-imposed charges. Requests made within 45 days of departure may be treated as a cancellation and rebooking.

Changes initiated by us: On rare occasions, we may need to modify your itinerary due to operational requirements, supplier availability, or other reasons. We will notify you as soon as possible. If the change is significant (e.g., hotel downgrade, major itinerary alteration), you may either accept the change or receive a full refund.

5. Our Liability

Clear Vacation Trips acts as an intermediary for third-party service providers including airlines, hotels, cruise operators, and local tour operators. We exercise care in selecting reputable partners, but we are not responsible for their operations. Accordingly, we accept no liability for:

• Personal injury, illness, or death caused by third-party providers;
• Delays, cancellations, overbookings, or labor disputes affecting transportation or accommodation;
• Loss, theft, or damage to personal belongings (claims must be filed directly with the relevant carrier or insurer);
• Changes to travel advisories or government warnings issued after booking.

Our total liability to you for any claim arising from your booking is limited to the total amount paid to us for the specific package in question, except where prohibited by law.

6. Insurance Requirement

Clear Vacation Trips strongly recommends that all clients obtain comprehensive travel insurance before departure. Insurance should provide coverage for:

• Medical expenses and emergency evacuation (minimum RM 500,000 coverage recommended);
• Trip cancellation, interruption, and delay;
• Baggage loss, theft, and damage;
• Adventure activities (if applicable to your itinerary).

Some of our packages may include basic insurance coverage — please check your confirmation documents. If you decline insurance, you accept full responsibility for any losses that could have been covered.

7. Documentation & Visas

It is your sole responsibility to ensure that you possess:

• A valid passport with at least 6 months of validity remaining after your return date;
• All necessary visas and entry permits for each destination;
• Required vaccinations and health certificates (e.g., Yellow Fever for certain regions);
• Any other documents required by immigration authorities.

Clear Vacation Trips provides general guidance on visa requirements but accepts no liability for denied entry, deportation, or any costs incurred due to inadequate documentation. We recommend using professional visa services for complex itineraries.

8. Force Majeure

Clear Vacation Trips shall not be liable for any delay, cancellation, or failure to perform its obligations due to events beyond our reasonable control, including (but not limited to): natural disasters, pandemics/epidemics, wars, civil unrest, terrorism, strikes, government-imposed travel bans, border closures, adverse weather conditions, and airline insolvency.

In the event of Force Majeure, we will work with suppliers to obtain refunds or credits where possible. However, we cannot guarantee the recovery of non-reimbursable costs. Travel insurance is essential to mitigate risks associated with Force Majeure events.

9. Data & Privacy

We collect and process personal information (including passport details, medical information, and contact details) in accordance with our Privacy Policy and the Malaysian Personal Data Protection Act 2010 (PDPA). Your data is used solely for booking, communication, and operational purposes. We do not sell or rent your data to third parties.

You have the right to access, correct, or request deletion of your personal data. By booking with us, you consent to the transfer of your data to third-party suppliers (airlines, hotels, etc.) as necessary to fulfill your travel arrangements.

10. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or relating to these terms or your booking shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.

We encourage you to first contact our customer service team to resolve any issues amicably before taking legal action. Complaints should be submitted in writing within 30 days of your journey's completion.

11. General Provisions

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement: These Terms, together with your booking confirmation and any supplemental documents, constitute the entire agreement between you and Clear Vacation Trips. No representation or promise not expressly stated herein shall be binding.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

12. Intellectual Property & Trademark Protection

All content, designs, graphics, photographs, logos, and materials displayed on this website — including but not limited to the Clear Vacation Trips name, logo, taglines, imagery, page layouts, and visual identity — are the exclusive intellectual property of Clear Vacation Trips and are protected under applicable trademark, copyright, and design laws.

You may not reproduce, distribute, modify, display, or create derivative works of any content from this website without our prior written consent. Unauthorized use of our intellectual property, including the copying of any design elements, photographs, or the logo, is strictly prohibited and may result in legal action.

The Clear Vacation Trips logo, brand name, and all associated marks are registered trademarks owned by Clear Vacation Trips. Any use of these trademarks without express permission is a violation of our rights. We actively monitor and enforce our intellectual property rights to protect the integrity of our brand.

13. Age & Fitness Requirements

By booking with Clear Vacation Trips, you confirm that you are at least 18 years of age. For clients under 18, a parent or legal guardian must accompany them and accept full responsibility. Certain tours may have age restrictions or minimum fitness levels (e.g., Everest Base Camp trek requires good physical condition). You are responsible for assessing your fitness to participate. We reserve the right to refuse service to anyone posing a safety risk to themselves or others.
